Policies For Job Seekers

Welcome and thank you for using PASAJOB, a referral-based job platform designed to reward individuals (the "Referrers") who wish to help their friends who may be qualified candidates (the "Job Seekers") to job vacancies/openings by referring them to job posts/advertisements posted by hiring employers (the "Hiring Employers").

Please take the time to carefully read these terms and conditions which are legally binding on you (the "User" or "You") and shall govern your use and/or continued access to PASAJOB (the "Service/s"), which is a technology owned/powered by PASAJOB INC. ("PASAJOB") and operated by its licensee herein, WESEARCH @ SEARCHERS & STAFFERS CORP. ("WESEARCH").

In General

  1. As a User, you unconditionally agree to be bound by these Policies, which are deemed incorporated and made an integral part of the Terms Of Use.
  2. Your use and/or continued use of the services constitutes your clear, express, and unconditional consent to be bound by these Policies, including any action made by any of your officers, employees, authorized representatives, and similar therewith. If you do not agree to these Policies, you are required to discontinue using the Services; otherwise, you are deemed to have given your unconditional consent as stated herein.
  3. You have the responsibility to regularly review these Policies. We reserve the right to revise and/or amend them at any time without prior notice. The revision or amendment are immediately effective once they are posted on the Service or at https://www.PASAJOB.com. Your continued use and/or access of the Service after the revisions or amendments, whether read and/or reviewed by you, constitutes your unconditional consent to be bound by the changes.

Definition of Terms

  1. "Employers" or "Hiring Employers" – refer to duly registered organizations or businesses aiming to hire employees through the Service.
  2. "Employer's Agents" – refer to the Employers' officers, managers, employees, representatives, and similar therewith who have been given or allowed access to the Employer's User Account.
  3. "Job Seekers" – refer to qualified candidates applying for employment through the Service.
  4. "Personal Data" – refers to all types of personal information as defined under Data Privacy Laws and Regulations, including personal information and sensitive personal information.
  5. "Platform" or "Service" – refers to the collective designation of the PASAJOB platform and services.
  6. "Policies" – refer to all current and future policies, such as the Privacy Policy, Code of Conduct for Users, and separate/individual policies that may be issued from time to time, including notices, policies, guidelines, frequently asked questions (FAQs), forms and contracts, whether digital or printed, that may be provided.
  7. "Referrers" – refer to persons who refer job posts/advertisements on the Platform to qualified candidates to employers.
  8. "Third Party Providers" – refer to independent providers of technology or services which may be used separately or integrated into the Service, including digital payment platforms, accounting services, and similar thereto.
  9. "Users" – refer to any person, whether an individual or an entity, who uses the Service.
  10. "User Content" – refers to user submissions or posting, such as uploaded data, information, media, and analogous thereto.

Representations, Warranties, Undertakings

You hereby represent, warrant, and/or undertake the following:

  1. You hereby confirm and affirm that you gave your unconditional and informed consent when a Referrer submitted your contact details to the Platform to refer you a job post for which you may be qualified, whether you are already an existing user or became a user as a result thereto.
  2. You hereby acknowledge that the Referrer who provided your contact details on the Service has only the act of referring you or calling your attention to a job post or advertisement. You understand that such act is not to be constituted, in any way shape or form, as an act of hiring and/or recruitment by the Referrer as the latter is not authorized nor empowered to do so on behalf of the Employers and/or Us.
  3. You shall genuinely apply for job posts or vacancies which you intend to be hired and which you are competent and/or qualified to perform based on either or a combination of your work experience, certifications or other forms of qualifications, educational and training background, special or unique skills, among others.
  4. You shall attend scheduled job interviews and/or qualification tests/exams that an employer may have scheduled for you in relation to your job application. If you have confirmed a schedule, you shall exert all reasonable efforts to attend it. Should you be unable to attend, you shall inform the employer of the reason within a reasonable period prior to the scheduled event and in no case less than 24 hours.
  5. You shall not conspire nor connive with Referrers to defraud Employers and/or us of the Referral Commissions, including but not limited to, entering into any form of arrangement whereby you, without any genuine intent to work for an employer, would apply for the position and be hired in order for the referrers to receive the Referral Commissions and thereafter you would leave employment after less than thirty (30) days of work. This applies whether or not the referral commissions were received solely by the Referrer and/or shared with you through any form or manner, such as in cash or in kind.
  6. You hereby waive any right or cause of action against the Employer and/or us arising out of or in connection with:

    1. referrers providing your contact details on the Service;
    2. referrers who misrepresent themselves as having authority to hire and recruit on behalf of Employers when, in fact, they do not have such authority; and
    3. referrers who engage in any fraudulent or illegal activities.

    Referrers are only allowed to refer or call your attention to a job post or advertisement that you may be qualified for by providing your contact details on the Service, and nothing more.

Payments and Taxes

  1. If you created an account as a Job Seeker and subsequently intend to refer, you shall be bound by the same terms and conditions, as well as policies and procedures, applicable to Referrers, particularly on payments and taxes.
  2. For rewards or promotions, payment terms and methods shall be covered by separate policies.
